Online Subscription Agreement

Last updated: September 12, 2026

This Online Subscription Agreement (the “Agreement”) is the contract between AfterVue LLC, a Florida limited liability company (“AfterVue”, “we”, “us”), and the practice that subscribes to the AfterVue App online (“you”, “your practice”). It applies to every subscription purchased through the checkout at getaftervue.com/signup.

If your practice has signed an AfterVue Order Form and Master Subscription & Services Agreement, that signed agreement governs your subscription and this one does not apply. This Agreement exists so that a practice which subscribes online — without signing anything — still has a complete, written contract covering price, allowance, overage, renewal and cancellation. It is not a summary of another document. It is the agreement itself.

1. Accepting this Agreement

You accept this Agreement by checking the acceptance box in the AfterVue checkout and completing your purchase. Our payment processor records the fact and the timestamp of that acceptance against your order, and we keep that record for as long as your subscription is active and for seven years afterwards.

The tier, plan term, price and any add-on quantities shown on the checkout page at the moment you complete your purchase form part of this Agreement, together with your payment receipt. Where those order details and this Agreement disagree about a figure, the order details control for that order.

You confirm that you are authorised to enter into this Agreement on behalf of your practice.

2. What you are subscribing to

The AfterVue App, at one of three tiers:

 Consult RoomPracticeGroup
Monthly price$349$699$1,499
Locations included113
Previews included each month5001,5004,000
iPad consult modeYesYesYes
Website embed widget—YesYes
Hosted try-it link and QR code—YesYes
Usage dashboardYesYesYes, per location

Additional locations. Beyond the three included in the Group tier, further locations are $399 per month each and add 1,000 previews per month each. Orders for three or more additional locations, and any white-label or reseller arrangement, are not sold through online checkout and require a separate written agreement with us.

Unlimited patients, always. There is no cap on how many patients you may use the App with, and no per-patient fee, on any tier.

This Agreement covers the App only. Any other work you ask us to do is quoted and contracted separately.

3. What counts as a preview

A preview is one patient, one treatment selection, one intensity level — both angles included. Re-rolling the same selection inside the same session is free and does not count again.

Previews generated through your practice’s own try-it link count against your allowance. Previews generated by visitors to AfterVue’s own public demo page do not, and are never counted toward or against your practice.

4. Fees, terms and billing

4.1 Month-to-month. Billed monthly in advance at the rates in Section 2, starting on the day you subscribe and recurring on that same day each month.

4.2 Prepaid terms. Six-month and twelve-month plans are discounted 10% and 15% respectively and are paid in full at the time of purchase, not monthly. Any “effective monthly” figure shown at checkout is for comparison only; the charge is the single upfront total:

TierMonth-to-month6 months (10% off)12 months (15% off)
Consult Room$349 / mo$1,884 total$3,564 total
Practice$699 / mo$3,774 total$7,128 total
Group$1,499 / mo$8,094 total$15,288 total
Additional location$399 / mo$2,154 total$4,068 total

We do not offer a twenty-four-month term.

4.3 Setup fees. A setup fee is charged where AfterVue does integration work, and not otherwise:

TierMonth-to-month6 months12 months
Consult RoomNoneNoneNone
Practice$499$250Waived
Group$999$500Waived
Additional location$250$125Waived

Consult Room carries no setup fee at any term, because nothing is embedded, no site is touched and no surfaces are configured — it is an iPad and a signed practice code. Setup fees, where charged, are billed once with your first payment and are non-refundable once the corresponding onboarding work has been delivered.

4.4 Payment method. We accept ACH bank debit and major cards. By subscribing you authorise AfterVue and its payment processor to charge your chosen payment method for the amounts described in this Agreement as they fall due, and you agree to keep a valid payment method on file for as long as any recurring or arrears charge can arise.

4.5 Taxes. All fees are exclusive of sales, use, excise and similar taxes, which are added where applicable and are your responsibility, other than taxes on AfterVue’s net income.

4.6 Price changes. Fees for a prepaid term are locked for the whole of that term — we will not raise the price of a term you have already paid for, for any reason. For a month-to-month subscription we may change the recurring fee on at least thirty days’ written notice, effective no earlier than your next billing date.

4.7 Billing disputes. Tell us in writing within fifteen days of a charge if you dispute it in good faith. Amounts not in dispute stay due on schedule.

5. Allowance and overage

5.1 Reset. Your included preview allowance resets on your monthly billing anniversary — for a prepaid term, on the same monthly anniversary the subscription would have billed had it been month-to-month. Unused previews do not roll over.

5.2 Notice at 100%. When your previews in a billing period reach 100% of your allowance, we will tell you — in the usage dashboard and by email to the contact on file — that you have reached it and that further previews that period will be billed as overage. This notice does not suspend or throttle anything.

5.3 Notice at 120%. At 120% of allowance we will send a second notice suggesting the next tier or an additional location, whichever fits. This notice likewise suspends nothing.

5.4 Overage rate. Each preview beyond your allowance in a billing period is billed at $0.35 per preview, charged monthly in arrears for the previous period’s actual usage. Overage is never prepaid, is never part of a prepaid term total, and is never reduced by the 10% or 15% term discount or any other discount.

5.5 We will not cut you off for going over. AfterVue will not suspend or degrade the App because you are incurring overage. Section 10 governs suspension for an unpaid invoice — an unpaid overage invoice is treated the same as any other unpaid fee, and no worse.

6. Renewal

6.1 Month-to-month renews monthly. A month-to-month subscription continues, and is charged, each month until you cancel under Section 7.

6.2 A prepaid term does not silently re-lock. When a six- or twelve-month term ends, your subscription converts to month-to-month at the then-current monthly rate. It does not automatically renew into another prepaid term, and you are not charged another lump sum. Renewing into a new prepaid term is opt-in: you have to tell us in writing that you want it.

6.3 Advance notice. For any term of twelve months or longer, we will send you written or electronic notice between thirty and forty-five days before the term ends, stating that the term is ending, that it will convert to month-to-month unless you opt in, the month-to-month and prepaid rates then in effect, and how to opt in.

7. Cancelling

7.1 Month-to-month — cancel any time. You may cancel a month-to-month subscription at any time, with no notice period and no reason required. Cancel from the billing portal linked in your receipt, or email support@getaftervue.com. Your cancellation takes effect at the end of the billing period you are already in, so you are never charged again after you cancel. The month you have already paid for is not refunded and is not prorated — you keep the Service for the rest of it.

7.2 A prepaid term runs to the end of its term. Six- and twelve-month plans are paid in full at purchase in exchange for a 10% or 15% discount, and that discount is given in exchange for the full term. If you end a prepaid term early, there is no refund and no proration of the remaining months. No part of the prepaid fee is returned, and no early-termination calculation applies in either direction. Your access continues for the whole term you paid for.

7.3 The one exception — if we are the ones who stop. If AfterVue permanently discontinues the Service, or the Service is materially unavailable for a prolonged period through our own fault, we will refund the unused portion of your prepaid term. This is the only circumstance in which a prepaid fee is returned. It does not apply to third-party outages outside our control, to scheduled maintenance, or to your own decision to stop using the Service.

7.4 If you decide not to commit, do not commit. We sell month-to-month through checkout precisely so that nobody has to take a long commitment on a product they have not used. Start month-to-month, use it for as long as you like, and move to a six- or twelve-month plan when you are confident it is worth it. That is the recommended path, and it is why Sections 7.2 and 8 can be as firm as they are.

7.5 Termination for cause. Either of us may terminate for material breach that is not cured within thirty days of written notice — ten days for a payment breach. If we terminate for your uncured breach, outstanding amounts become immediately due and Section 7.2 applies unchanged.

7.6 What happens after. Your practice codes stop working and any embedded widget deactivates. On request within thirty days we will return your own brand assets and any data of yours we hold. Accrued fees, including overage for the final period, remain payable.

8. No performance or satisfaction guarantee

AfterVue makes no guarantee of any kind about the results you will get. We do not guarantee any number of patient bookings, consultations kept, procedures performed, or revenue; we do not guarantee any change in your conversion rate; and we make no representation about the clinical result any patient will achieve. There is no satisfaction guarantee and no performance guarantee, and neither a refund nor a service credit is available on the basis of results.

Any statement by anyone at AfterVue about expected results is an estimate and is not binding. Nothing said in a demonstration, a sales conversation, an email or on our website creates a guarantee, and no such statement varies this Agreement.

What you are buying is the Service described in Section 2 — the App, the preview allowance, and the surfaces your tier includes — and our obligation is to provide it in a professional and workmanlike manner (Section 15). That obligation is real and Section 7.3 is what backs it. Results are not part of the bargain.

9. Free trial codes

A trial code unlocks the App only, for three calendar days from first activation — not from the date the code was issued — and is capped at fifty previews in total. Whichever limit is reached first ends the trial. No payment method is required and no charge occurs automatically at the end of a trial: becoming a paying subscriber takes a deliberate act by you. A trial code activates once and cannot be reactivated, transferred or reused.

10. Late payment and suspension

If a payment method is declined, you have five business days to put a working one in place. After written notice and that cure period we may suspend the App for non-payment without further liability. Suspension does not cancel amounts already owed. Overdue amounts accrue interest at the lesser of 1.5% per month or the maximum the law allows.

We may also suspend the Service where continuing it would, in our reasonable judgement, break the law or create material regulatory exposure — including a suspected failure to obtain patient consent.

11. Your responsibilities

You are responsible for: obtaining every consent the law requires from each patient before their image is captured (see Section 12); using the App only for lawful, non-deceptive patient communication; the accuracy of anything you publish using a preview; and keeping your practice codes confidential — a practice code is a credential, and anyone holding it can generate previews billed to you.

12. Patient photographs and privacy

12.1 What happens to a photo. A patient photograph is sent to our AI rendering partner solely to produce that preview. Photos are used for the preview only — never sold, never used to train AI. AfterVue does not store the photograph after the session; our rendering partner may retain it briefly for security monitoring.

12.2 Consent is yours to obtain. You are solely responsible for obtaining all consents required by applicable law for capturing and AI-processing a patient’s photograph and facial-geometry data, including under any state biometric privacy statute such as Illinois BIPA, Texas CUBI or Washington’s My Health My Data Act. The App provides a consent screen to help you do this; using it does not move that legal responsibility to AfterVue.

12.3 Consent logging. We log the fact and timestamp of each patient’s consent — never the image — so you can show that consent was taken.

12.4 Your practice remains the covered entity. Nothing in this Agreement makes AfterVue a covered entity, and nothing here transfers your own obligations under health-privacy law to us.

12.5 An online subscription does not include a Business Associate Agreement, and none is offered with it. If your compliance programme requires you to have one in place with a vendor that processes patient images, do not subscribe online — write to legal@getaftervue.com first and we will tell you plainly where that stands before you buy anything. We would rather lose the sale than have you rely on something that is not in place.

12.6 Sub-processors. We use reputable sub-processors — hosting, storage, CDN and model inference — to run the Service, and remain responsible for their performance under this Section. A current list is available on request.

12.7 Security incidents. We will notify you without undue delay after becoming aware of a confirmed security incident affecting your data, and will cooperate reasonably in your response.

12.8 Real patient photographs — not yet

Do not use AfterVue with a real patient’s photograph until we confirm to you, by email, that our infrastructure and a Business Associate Agreement are in place. Until you receive that confirmation, please use staff or sample images only. This is a real, temporary restriction and it is a condition of your subscription, not a suggestion. We will tell you the moment it lifts, and the restriction does not extend your term or change what you pay.

13. Previews are simulations

Every AfterVue preview is an illustrative simulation, not a clinical prediction, promise or guarantee of any outcome. It is not medical advice and it is not a substitute for a clinician’s judgement. You must not present a preview to a patient, or in advertising, as a guaranteed or expected result, and you are responsible for complying with the advertising and before-and-after imagery rules that apply to your profession and state.

14. Ownership and licence

As between us, you own the patient photograph you submit. We grant you a non-exclusive, worldwide, royalty-free licence to use, reproduce and display previews generated for your patients, for patient consultation and your own marketing, subject to Sections 11 and 13. A purely AI-generated image may not attract copyright protection at all under current U.S. guidance; this Section governs our respective rights either way, and we are not representing that you acquire a copyright that may not exist.

AfterVue and its licensors retain all rights in the Service itself — models, software, prompts, workflows and improvements — regardless of feedback you give us.

15. Warranties and disclaimers

Each of us warrants that we have the authority to enter into this Agreement. We warrant that we will perform the Service in a professional and workmanlike manner.

EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, AND AFTERVUE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT PREVIEWS WILL BE ACCURATE OR REFLECT ACTUAL CLINICAL RESULTS, OR THAT ANY PARTICULAR BOOKING, REVENUE OR CLINICAL OUTCOME WILL BE ACHIEVED.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST GOODWILL OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY.

Except for the excluded claims below, each party’s total aggregate liability arising out of or related to this Agreement will not exceed the greater of $100 or the fees paid or payable by you in the twelve months immediately before the event giving rise to the claim.

That cap and that exclusion do not apply to: your payment obligations; either party’s indemnification obligations under Section 17; a party’s gross negligence, wilful misconduct or fraud; breach of confidentiality; or any liability that cannot be limited by law.

17. Indemnification

We will defend and indemnify you against third-party claims to the extent they arise from our gross negligence or wilful misconduct, or from an allegation that the App infringes a third party’s intellectual property rights (excluding your own brand assets and content).

You will defend and indemnify us against third-party claims to the extent they arise from: your brand assets or content, including clinical, efficacy, before-and-after or pricing claims you approve; your clinical services, licensure or professional conduct; your failure to obtain patient consent under Section 12.2; your violation of healthcare-advertising, biometric-privacy, anti-kickback, consumer-protection or marketing-consent law; or your breach of this Agreement.

The party seeking indemnity will notify the other promptly, give it control of the defence, and cooperate reasonably at that party’s expense.

18. Changes to this Agreement

We may update this Agreement. For a material change we will give at least thirty days’ notice by email to the contact on file and by updating the date at the top of this page. The change takes effect at your next billing date after that notice; if you do not accept it, you may cancel under Section 7 before it takes effect. A change to this Agreement never alters the price or the length of a prepaid term you have already bought.

19. General

AfterVue is an independent contractor; nothing here creates a partnership, joint venture, employment or agency relationship. Neither of us may assign this Agreement without the other’s consent, except to a successor in a merger or sale of substantially all assets. If any provision is unenforceable, the rest survives. A failure to enforce a provision is not a waiver of it. Sections 4 (for amounts accrued), 11, 12, 13, 14, 15, 16, 17 and 19 survive termination.

This Agreement, together with your checkout order details, the Terms of Service, the Privacy Policy and the Refund Policy, is the entire agreement between us about the App, and replaces any prior proposal or statement about it. Where this Agreement conflicts with the Terms of Service, this Agreement controls for your subscription.

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in the Florida county where AfterVue LLC maintains its principal office, and each of us consents to their jurisdiction. Where permitted, each of us waives a jury trial.
